Civil litigation in South Africa is governed by the Magistrates' Courts Act 32 of 1944 and the Uniform Rules of Court. The choice of forum depends on the amount in dispute and the nature of the claim. Our attorneys will advise you on the most appropriate forum and the most cost-effective strategy for your matter.

Debt recovery is one of the most common areas of civil litigation. We assist creditors to recover outstanding amounts through demand letters, summons, default judgments and, where necessary, the attachment and sale of the debtor's assets. We also assist debtors who are facing unfair or unlawful collection practices.

Urgent applications — such as interdicts to prevent the dissipation of assets or to stop an unlawful act — require swift, decisive action. Our attorneys are experienced in bringing and opposing urgent applications and are available to assist clients in time-sensitive matters.

Frequently Asked Questions

What is the difference between the Magistrates' Court and the High Court?

The Magistrates' Court has jurisdiction over claims up to R400 000 (district court) or R800 000 (regional court). The High Court has unlimited jurisdiction and handles more complex matters. The choice of forum affects the cost and duration of the proceedings.

How long does civil litigation take?

This depends on the complexity of the matter and the court's roll. An undefended debt recovery matter can be finalised in 2–3 months. A fully contested trial in the High Court can take 2–4 years from the date of summons to judgment.

What is a default judgment?

A default judgment is a judgment granted in favour of the plaintiff when the defendant fails to enter an appearance to defend or fails to file a plea. Once a default judgment is granted, the plaintiff can proceed to execute against the defendant's assets.

Can I claim legal costs from the other party?

In South African civil litigation, costs generally follow the result — the losing party is ordered to pay the winning party's legal costs. However, costs are awarded on a party-and-party scale, which does not cover all of the winning party's actual legal costs.
