South African divorce law is governed by the Divorce Act 70 of 1979. A marriage may be dissolved on the ground of irretrievable breakdown. Our attorneys will advise you on whether your marriage is out of community of property, in community of property, or subject to the accrual system — each of which has significant implications for how assets and liabilities are divided.

Where children are involved, the Children's Act 38 of 2005 places their best interests at the centre of every decision. We assist parents in drafting comprehensive parenting plans that address primary residence, contact, decision-making and financial support — reducing conflict and providing certainty for the whole family.

We represent clients in the Western Cape High Court and the Magistrates' Court, and we are experienced in both negotiated settlements and fully contested divorce trials. Our goal is always to achieve the best possible outcome for you in the most cost-effective and time-efficient manner.

Frequently Asked Questions

How long does a divorce take in South Africa?

An uncontested divorce where both parties agree on all issues can be finalised in as little as 4–8 weeks. A contested divorce that proceeds to trial can take 12–24 months or longer depending on the complexity of the matter and court roll availability.

Do I need to appear in court for my divorce?

In an uncontested divorce, only the plaintiff (the party who institutes the action) needs to appear in court. In a contested divorce, both parties will be required to testify.

What happens to our house when we divorce?

This depends on your marital regime. In community of property, the house forms part of the joint estate and must be divided equally. Out of community of property with accrual, the house may be included in the accrual calculation. Out of community of property without accrual, each spouse retains their own assets. We will advise you on the best approach for your specific situation.

How is child maintenance calculated?

Child maintenance is calculated with reference to the needs of the child and the means of both parents. The Maintenance Act provides a framework, but the court has discretion to award an amount it considers just and equitable.
